Conditions of Use for the German Location Code List, Version 17.0 and the Event Code List, Version 4.01

The Federal Republic of Germany represented by the Bundesministerium für Verkehr und digitale Infrastruktur (Federal Ministry of Transport and Digital Infrastructure (BMVI)) supplies the German Location Code List, Version 17.0 and Event Code List 4.01 via the Bundesanstalt für Straßenwesen (Federal Highway Research Institute (BASt)) on the following conditions:

    1. The user commits himself to make known the use of the German Location Code List Version 17.0 (LCL 17.0) and respectively the Event Code List Version (ECL) 4.01, to BASt. The "Proof of Use" slip is to be used for this purpose.
    2. The user receives, at no charge, a not sub-licensable license to use both lists, for the given use. This right of use does not apply for updated versions of the lists. The disclosure of the German LCL 17.0 or ECL 4.01 by the user to third parties is principally not admissible.
    The disclosure to third parties is exceptionally admissible, if the user disseminates the LCL or the ECL as component of a device or software or a digital map or its update, which is produced by him. In this case the user has to take appropriate measures to ensure, that a third party can´t bring any liability or warranty claims towards the Federal Republic of Germany, the BMVI or the BASt because of correctness, completeness or content of the LCL or the ECL. If there are any claims by third parties, the user shall indemnify the Federal Republic of Germany, the BMVI and the BASt.
    3. The attention of the user is drawn to the fact that, in the case of a connection to the traffic warning service of the police, the respective codes of practice in force (at present: Codes of Practice for a Connection to the Traffic Warning Service of the Police, dated 9. November 2000, Traffic Gazette 2000, page 642) apply.
    4. BMVI and BASt assume no liability for the completeness or accuracy of the LCL/ ECL and/or its contents or for the presence of technical faults or mistakes in its content.
    5. BMVI and BASt assume no liability for direct or indirect loss or damage, which could be connected with the use of the LCL.
    6. With regard to points 4. and 5., liability of a third party is excluded to the same extent.
    7. The period of validity of the LCL, Version 17.0/ ECL 4.01 cannot be stated at present; BMVI and BASt therefore accept no responsibility for the length of validity of the LCL/ ECL at issue.
